Clear terms for using Finsway.

These Terms explain your rights and responsibilities when you create an account and use the Finsway early beta.

The essentials before you begin

Finsway is currently a free early beta.

BY CREATING A FINSWAY ACCOUNT

  1. 01you agree to these Terms;
  2. 02you understand that the product is still being tested;

  4. 04you understand that Finsway does not connect to your bank or move money;
  5. 05you agree to use the service lawfully and responsibly; and
  6. 06you understand that features and availability may change during testing.
No payment details are required during the early beta.

Your beta account will not automatically become a paid subscription.

1. Overview

Finsway is an early-stage software product based in Dubai, United Arab Emirates. In these Terms, “Finsway,” “we,” “us” and “our” refer to that operator.

2. Agreement to these Terms

These Terms apply to:

  • the Finsway website;
  • the early-beta web application;
  • any related mobile or desktop application we may make available;
  • product demonstrations;
  • support services; and
  • other features or services provided under the Finsway name.

By creating an account you agree to these Terms. If you do not agree, do not create an account or use the application.

Electronic agreements and electronic acceptance can form valid contracts under UAE law.

Please also read the Finsway Privacy Policy, which explains how personal data is handled.

3. Eligibility

You must:

  • be at least 18 years old;
  • have the legal capacity to enter into these Terms;
  • provide accurate account information; and
  • use Finsway only in accordance with applicable law.

Where the law applying to you requires a higher minimum age or additional consent, that requirement applies.

You may not create an account on behalf of another person without proper authority.

4. The Finsway service

Finsway is a money-planning application.

It allows users to manually organise available money across purposes such as:

  • taxes;
  • owner pay;
  • personal pay;
  • operating expenses;
  • bills;
  • reserves;
  • savings;
  • personal or business goals; and
  • amounts considered safe to spend.

Finsway provides a planning layer over information entered by the user.

Finsway does not:

  • connect directly to bank accounts;
  • request online-banking credentials;
  • automatically import bank transactions;
  • hold customer funds;
  • move money between accounts;
  • initiate payments;
  • verify balances against financial institutions;
  • act as a bank, payment provider, accountant, broker, or financial adviser; or
  • make financial decisions on behalf of users.

Any allocation or remaining-balance calculation depends on the figures and rules you enter.

5. Early-beta access

Finsway is currently provided as a limited early beta.

Access during the beta is free of charge.

No payment card or payment authorisation is required.

Because the product is still being tested:

  • features may be introduced, changed, restricted, or removed;
  • some features may be incomplete;
  • calculations, terminology, or displays may change;
  • errors may occur;
  • service availability may be interrupted;
  • access may be limited to selected users; and
  • the early beta may be paused or discontinued.

Beta access does not guarantee permanent access to Finsway or to any particular feature.

We will try to communicate material changes where reasonably practical, but rapid changes may sometimes be required for security, reliability, or product-development reasons.

6. Future paid plans

Finsway may introduce paid plans after the early beta.

If that happens:

  • pricing will be displayed before payment is requested;
  • relevant subscription terms will be provided;
  • payment information will be requested only when you actively choose a paid plan;
  • your beta registration will not automatically become a paid subscription; and
  • Finsway will not charge you without your explicit agreement and payment authorisation.

You are under no obligation to join a paid plan.

We may change, limit, or discontinue free-beta access after giving reasonable notice where practical.

7. Account registration and security

You agree to provide information that is accurate, current, and complete.

You are responsible for:

  • keeping your account credentials confidential;
  • using a strong and unique password where passwords are used;
  • controlling access to your device;
  • activity carried out through your account; and
  • notifying us promptly if you believe your account has been accessed without permission.

Do not share your login credentials or allow another person to use your personal account.

Contact support@finsway.app if you suspect unauthorised access.

We may require account verification or additional security steps where reasonably necessary.

8. Your planning information

You retain ownership of the information you enter into Finsway.

This may include:

  • balances;
  • income amounts;
  • client payments;
  • category names;
  • allocation percentages;
  • goals;
  • planned expenses;
  • spending updates; and
  • notes.
  • You give Finsway a limited permission to host, store, process, display, back up, and transmit that information only as reasonably necessary to:

    • operate the application;
    • perform requested calculations;
    • save your plan;
    • provide support;
    • maintain security; and
    • improve the reliability of the service.

    This permission lasts while your information remains in the service and ends when it is deleted, subject to reasonable backup periods and legal retention requirements.

    We do not gain ownership of your financial-planning information.

9. Accuracy and responsibility for information

You are responsible for the accuracy and completeness of the information you enter.

Finsway does not verify your information against:

  • bank records;
  • tax records;
  • invoices;
  • accounting systems;
  • payroll records; or
  • financial statements.

A balance or allocation shown in Finsway may be incorrect or outdated if:

  • information was entered incorrectly;
  • spending or income was not updated;
  • a calculation rule does not reflect your situation;
  • circumstances changed; or
  • the application contains an error.

You should independently verify important financial information before acting on it.

Keep appropriate business, accounting, tax, and financial records outside Finsway.

10. Acceptable use

You may use Finsway for lawful personal or internal business-planning purposes.

You agree not to:

  • use Finsway for illegal, fraudulent, or deceptive activities;
  • access another person’s account without authorisation;
  • impersonate another person or organisation;
  • upload malware, viruses, or harmful code;
  • interfere with the operation or security of the service;
  • attempt to bypass authentication or access restrictions;
  • attempt to access source code, infrastructure, or non-public systems without permission;
  • overload the service through excessive automated requests;
  • use bots, scrapers, or automated extraction tools without written permission;
  • copy, sell, rent, sublicense, or commercially redistribute the application;
  • remove copyright, trademark, or ownership notices;
  • use the Finsway name or branding in a misleading manner;
  • use the service to send unsolicited messages or spam;
  • enter information that you do not have the right to process;
  • use the service to violate another person’s privacy or intellectual-property rights; or
  • use the service in a way that could damage Finsway, its users, or its providers.

You may not resell access to the early beta.

You may not represent yourself as authorised by, employed by, or officially partnered with Finsway without written permission.

11. Professional use

The beta is intended for users planning their own business money. It is not currently intended for managing client accounts, holding client information or providing regulated professional services to other people.

12. Advice and calculations

Finsway is a planning tool.

The application and website content are provided for general informational and organisational purposes.

They are not:

  • financial advice;
  • investment advice;
  • accounting advice;
  • tax advice;
  • legal advice;
  • credit advice;
  • insurance advice; or
  • a comprehensive financial plan.

Finsway does not know your full financial position, tax status, legal structure, personal circumstances, or regulatory obligations.

Allocation percentages, examples, articles, templates, and calculations should not be treated as recommendations tailored to you.

Calculations shown by Finsway are based on the data and rules entered into the application.

Finsway does not guarantee that a displayed amount is:

  • legally available for withdrawal;
  • properly classified for tax purposes;
  • sufficient for future obligations;
  • consistent with accounting records;
  • appropriate for your circumstances; or
  • safe to spend in every sense.

The phrase “safe to spend” refers to the amount remaining within the plan after the allocations recorded by the user. It is not a guarantee that no other obligations exist.

You remain responsible for checking results before relying on them and should consult an appropriately qualified professional where professional advice is needed.

13. Product content and intellectual property

Finsway and its operator retain all rights in:

  • the software;
  • source code;
  • application design;
  • website design;
  • graphics;
  • interfaces;
  • written content;
  • product documentation;
  • trademarks;
  • logos;
  • brand assets; and
  • other original materials provided through the service.

Subject to these Terms, you receive a limited, personal, revocable, non-exclusive, non-transferable right to use Finsway during the early beta.

This right does not allow you to:

  • copy or reproduce the software;
  • distribute the application;
  • create a competing product from protected elements;
  • sell or sublicense access;
  • reverse engineer the software, except where a right to do so cannot legally be restricted; or
  • use Finsway’s intellectual property outside the permitted service.

No ownership rights are transferred to you.

14. Feedback

You may choose to provide:

  • suggestions;
  • feature requests;
  • comments;
  • interview responses;
  • usability feedback;
  • bug reports; or
  • other ideas.

You retain ownership of the original material you submit.

You grant Finsway a non-exclusive, worldwide, royalty-free licence to use feedback to develop, document and improve the service. We will not publicly attribute feedback to you or publish private screenshots, financial figures or testimonials without your permission.

15. Privacy

The collection and use of personal data are governed by the Finsway Privacy Policy.

That policy explains:

  • what information is collected;
  • how planning data is used;
  • which service providers may process information;
  • how long information may be retained;
  • how to request access or deletion; and
  • how to contact us about privacy.

By using Finsway, you acknowledge that you have had an opportunity to review the Privacy Policy.

16. Third-party services

Finsway may depend on third-party services for functions such as:

  • hosting infrastructure;
  • email delivery; and
  • service monitoring.

Third-party services operate under their own terms and privacy practices.

To the fullest extent permitted by law, we are not responsible for external websites you choose to access or for interruptions, acts, or omissions of independent providers outside our reasonable control. Nothing in this section limits responsibilities that mandatory law places directly on us.

A link does not necessarily mean that Finsway endorses the third party.

17. Service availability and changes

We aim to keep Finsway available and functioning, but the early beta is provided without a guaranteed availability level.

The service may be interrupted because of:

  • maintenance;
  • software updates;
  • hosting failures;
  • security incidents;
  • provider outages;
  • internet failures;
  • testing;
  • product changes; or
  • circumstances outside our reasonable control.

We may add or remove features, change interfaces or calculations, introduce usage limits, replace service providers, change technical requirements, or discontinue some or all of the beta.

Where a change materially affects users, we will try to give reasonable notice unless immediate action is necessary for security, law, or service reliability.

We do not guarantee that:

  • the service will always be available;
  • every error will be corrected;
  • every device or browser will be supported; or
  • a feature will remain available.

Events beyond our reasonable control may include internet or cloud-provider outages, cyberattacks, natural disasters, government action, civil disturbance, utility or labour disruption, and widespread technical failures. We will try to restore affected services where reasonably possible.

No online service can guarantee against every instance of data loss. Keep independent copies of records that are important to your business.

18. Suspension and termination

Ending your use

You may stop using Finsway at any time.

You may request account deletion by:

  • using the account-deletion feature, where available; or
  • contacting support@finsway.app.

Deletion is handled in accordance with the Privacy Policy.

Suspension or termination by Finsway

We may suspend or end access where reasonably necessary because:

  • you breached these Terms;
  • your use creates a security risk;
  • your activity may be unlawful;
  • your account is used fraudulently;
  • you interfere with the service;
  • continued access could harm another person;
  • we are required to do so by law; or
  • the early beta is being limited or discontinued.

Where appropriate and reasonably possible, we will explain the reason or provide notice.

We may act without advance notice where urgent action is necessary for security or legal compliance.

19. Disclaimers and limitations of liability

19.1 Beta service and no warranties

Finsway is an early-stage beta service provided free of charge for evaluation and feedback.

To the fullest extent permitted by applicable law, Finsway is provided “as is” and “as available,” without warranties, representations or conditions of any kind, whether express, implied or statutory. This includes implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, reliability, availability, title and non-infringement.

19.2 Exclusion of certain damages

To the fullest extent permitted by applicable law, neither Finsway nor its operator will be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from or connected with the service. This includes loss of profits, revenue, opportunity, goodwill or anticipated savings; business interruption; or loss or corruption of data, even if we were informed that such loss might occur.

We are not responsible for losses caused by inaccurate, incomplete or unauthorised information supplied by you; decisions made without independently checking Finsway’s outputs; use contrary to these Terms or available instructions; or failure to protect account credentials or maintain appropriate business records.

19.3 Liability cap

To the fullest extent permitted by applicable law, the total aggregate liability of Finsway and its operator for all claims arising out of or relating to the beta service or these Terms will not exceed the greater of:

  • the amount you paid to Finsway for the service during the 12 months before the event giving rise to the claim; or
  • USD 100 or its equivalent in your local currency.

The existence of more than one claim does not increase this limit.

19.4 Rights that cannot be limited

Nothing in these Terms excludes or limits liability for fraud, gross fault or wilful misconduct, death or personal injury caused by negligence, breach of mandatory data-protection obligations, or any other liability or statutory right that cannot lawfully be excluded or limited.

Some jurisdictions do not permit particular warranty exclusions, damage exclusions or liability limits. In those jurisdictions, the provisions above apply only to the maximum extent permitted by law.

20. Indemnity for misuse

To the extent permitted by law, you agree to compensate Finsway and its operator for reasonable losses, claims, and expenses resulting directly from:

  • your unlawful use of the service;
  • your intentional breach of these Terms;
  • content you submit without having the right to use it;
  • your infringement of another person’s rights; or
  • misuse of your account that results from deliberately sharing access credentials.

This section does not require you to compensate Finsway for losses caused by Finsway’s own misconduct or legal responsibility.

21. Changes to these Terms

We may update these Terms when:

  • the product changes;
  • the beta develops;
  • new features are introduced;
  • paid plans are added;
  • legal requirements change; or
  • changes are needed to protect users or the service.

The updated version will show a new “Last updated” date.

For material changes, we may provide notice by email, inside the application, or on the website.

Where appropriate, we may require you to accept updated Terms before continuing to use Finsway.

Continued use after the effective date may indicate acceptance where permitted by law.

22. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates and the laws applicable in the Emirate of Dubai.

Before beginning formal proceedings, you and Finsway agree to make a reasonable attempt to resolve the issue directly.

Unless mandatory law provides otherwise, disputes arising from these Terms or Finsway will be subject to the competent courts of Dubai, United Arab Emirates.

Nothing in this section removes consumer or statutory rights that cannot legally be waived.

23. General terms

Entire agreement

These Terms form the agreement governing your use of the early beta. The Privacy Policy separately explains how personal data is handled.

Severability

If a court finds one part of these Terms invalid or unenforceable, the remaining provisions will continue to apply.

No waiver

If Finsway does not immediately enforce a provision, that does not mean the provision has been waived.

Assignment

Finsway’s operator may assign these Terms as part of a reorganisation or transfer of the service, provided that your rights are not materially reduced and notice is provided where required by law.

Headings

Section headings are included for convenience and do not change the meaning of the Terms.

Language

These Terms are written in English.

If a translation is provided, the English version will govern to the extent permitted by applicable law.
